These terms govern access to and use of the Omicsy platform, including workspaces, datasets, storage, computational jobs, credits, documentation, and APIs.

These terms govern access to Omicsy and the use of Omicsy workspaces, datasets, storage, computational jobs, credits, documentation, and APIs.
Credit purchases are processed by Paddle as merchant of record. Paddle's buyer terms, privacy notice, and refund policy apply to payment transactions in addition to these Omicsy terms.
1. Service provider
Omicsy is operated by ZIBA Science Resources SL, an enterprise located in the Basque Country, Spain, with VAT number ES-B75190835 and registered address at Argoin 324, ES-20800 Zarautz. You can contact us at support@omicsy.com about these terms, privacy matters, account access, or data protection requests.
These terms apply to the Omicsy application, documentation, APIs, storage services, and computational workflows provided through the platform.
2. Purpose of the service
Omicsy provides cloud-hosted tools for managing biological datasets, processing bioinformatic workflows, and generating reports.
The service is intended for professional research and scientific use. You are responsible for ensuring that your use of Omicsy is permitted by your institution, funder, collaborator agreements, and applicable law.
3. Accounts and access
You must provide accurate account information, keep your credentials confidential, and notify us if you believe your account has been compromised.
Workspace owners and administrators control access to workspace data. Workspace activity is visible to authorized members and, where necessary, to Omicsy staff for support, security, billing, or service operation.
4. Customer data and responsibilities
You retain responsibility for datasets, metadata, reference materials, job parameters, outputs, and other content that you upload, generate, or share through Omicsy.
Do not upload content unless you have the right to process it in Omicsy. Do not upload patient-identifiable, human-subject, confidential, export-controlled, or otherwise regulated data unless you have confirmed that Omicsy is approved for that use and the required agreements are in place.
You are responsible for maintaining independent copies of critical data. Omicsy is a processing and collaboration platform, not the sole archive for irreplaceable research data.
5. Acceptable use
You may not use Omicsy to violate laws, infringe rights, disrupt the service, bypass access controls, probe other users' data, overload infrastructure, reverse engineer protected components, or submit malicious files or instructions.
We may suspend or restrict access where needed to protect users, workspaces, infrastructure, billing integrity, or legal compliance.
6. Credits, billing, and computational jobs
Omicsy may estimate, reserve, settle, refund, or adjust credits for computational jobs, storage, and other platform usage. Estimates may differ from final costs because runtime, selected resources, retries, storage, cloud pricing, and job outcomes can vary.
You are responsible for reviewing job settings before submission. Omicsy will validate that your workspace has the required permissions and sufficient credits before allowing a job to run.
Credit purchases are one-time transactions processed by Paddle as merchant of record. Automatic credit top-ups may be available where supported by Paddle. Paddle applies applicable taxes based on your billing location and issues receipts or invoices. Do not send payment card details to Omicsy support.
The Paddle receipt will confirm the purchase amount, applicable taxes, and any terms for automatic top-up arrangements where enabled.
7. Product access, fulfillment, and support
After a successful payment, Omicsy will make the purchased credits available as soon as technically practicable.
If credits are not activated after a successful payment, contact support@omicsy.com with the account email and Paddle receipt information so we can investigate without asking for full payment card data.
We aim to acknowledge support and complaint messages within 2 business days and to provide either a resolution or a status update within 30 days. Mandatory consumer dispute rights available in your location are not limited by these terms.
8. Intellectual property
Omicsy, its software, workflow designs, interface, documentation, and service materials are owned by ZIBA Science Resources SL or its licensors and are protected by intellectual property laws.
You retain rights in datasets, metadata, reference materials, job parameters, outputs, and other content that you upload or generate through Omicsy, subject to the permissions needed for Omicsy to host, process, secure, back up, display, and deliver that content as part of the service.
9. Privacy
Omicsy's handling of personal data is described in the Omicsy Privacy Notice. Paddle's handling of buyer and payment data is described in Paddle's privacy notice.
By creating an account, accepting these terms, or using Omicsy, you acknowledge the processing described in the Privacy Notice.
Where your organization processes personal data of individuals using Omicsy as a data processor on your behalf, a Data Processing Agreement (DPA) is available upon request at support@omicsy.com. Organizations subject to GDPR should ensure a DPA is in place before uploading personal data of identifiable individuals.
10. Suspension and termination
We may suspend, restrict, or terminate access where needed to protect users, workspaces, infrastructure, billing integrity, payment compliance, security, or legal obligations.
You may stop using Omicsy at any time. Any unused credits remaining at the time of account closure are non-refundable but may be transferred to another Omicsy user.
Termination does not automatically delete records that Omicsy or Paddle must retain for security, billing, audit, tax, legal, dispute, or fraud-prevention reasons.
11. Disclaimers and liability
Omicsy is provided for professional research and scientific workflows. We do not warrant that outputs are scientifically valid for every purpose, that cloud resources will be uninterrupted, or that all third-party services will remain available.
To the maximum extent permitted by applicable law, Omicsy is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost research opportunities, loss of goodwill, or loss of data where such liability can lawfully be limited.
Nothing in these terms limits liability that cannot be limited under applicable law, including mandatory consumer rights where they apply.
12. Changes
We may update these terms when the service, payment setup, processing activities, legal requirements, or infrastructure change.
If a material update requires renewed acceptance, Omicsy will ask you to accept the current version before continuing to use the application.
Where Paddle requires updated buyer-facing terms, refund policy, product terms, or contact details, we will update the relevant public pages accordingly.
13. Governing terms
These terms are governed by the laws of the Kingdom of Spain unless a separate written agreement states otherwise. Users in the European Union also benefit from mandatory protections under applicable EU law, which these terms cannot override.
If a separate signed agreement between your organization and Omicsy conflicts with these terms, the signed agreement controls for that organization to the extent of the conflict.
For transactions completed through Paddle, Paddle's buyer terms and refund policy govern the payment transaction, statutory withdrawal rights, payment disputes, and Paddle-managed refunds.
